For the entrant: By entering this Prize Draw, you are indicating your agreement to be bound by these terms and conditions and acknowledge how personal information about you may be used.
1. Prize Draw
The title of this Prize Draw is the Essential Living and HomeQuarters Prize Draw 2024 (the Prize Draw).
2. Promoter
The promoter is: Essential Living Management Services Limited (Company number 10201586) of 33 Cavendish Square, London, England, W1G 0PP (the Promoter). HomeQuarters is a portfolio brand owned and managed by the Promoter.
3. How to enter
a. The Prize Draw will run from 00:01 BST on Tuesday 12 March 2024 to 23:59 BST on Friday 31 May 2024 (the Prize Draw Period).
b. All Prize Draw entries must be received by the Promoter during the Prize Draw Period. All Prize Draw entries received prior to the start of, or after the end of, the Prize Draw Period are automatically disqualified.
c. If an eligible entrant who has been entered automatically does not wish to enter the Prize Draw for any reason, please send an email to [email protected] with ‘Essential Living HomeQuarters Prize Draw 2023 opt-out' as the subject. The Promoter will then exclude your entry from the Prize Draw.
d. There is no entry fee and no purchase necessary to enter this Prize Draw.
e. By entering this Prize Draw, an entrant is indicating their agreement to be bound by these terms and conditions (the Prize Draw Terms).
4. Eligibility
a. The Prize Draw is open to all individuals aged over 18 at the start of the Prize Draw Period (with a maximum of one (1) entry per applicant) except:
i. employees of the Promoter or any company that is in the same group of companies as the Promoter;
ii. employees of agents or suppliers of the Promoter or any company that is in the same group of companies as the Promoter, who are professionally connected with the Prize Draw or its administration;
iii. members of the immediate families or households of (i) and (ii) above;
b. If you are not eligible to enter the Prize Draw the Promoter will automatically exclude your entry from the Prize Draw. The Promoter may require you to provide proof that you are eligible to enter the Prize Draw.
c. There is a limit of one entry per applicant, any subsequent entries by the same resident will be automatically disqualified.
d. The Promoter reserves all rights to disqualify any entrant if their conduct is contrary to the spirit or intention of the Prize Draw or otherwise in breach of these Prize Draw Terms. Any potential winner is subject to Promoter's verification of eligibility and compliance with law and these Prize Draw Terms.
e. The Promoter does not take any responsibility for any technical failure or malfunction, including but not limited to any failures affecting internet servers or email systems, which may result in any entry to the Prize Draw being lost or not properly registered or recorded.
f. Entrants are responsible for any charges of online service providers or wireless carriers.
5. The Prizes
a. One (1) entrant will be eligible to win a prize in the form of a voucher for John Lewis or Amazon. The first name drawn will win a voucher worth one thousand pounds sterling (£1,000). There will be one (1) Prize Draw Winners in total.
b. The Prize shall only be applied in the form of a voucher.
c. The Prize is not negotiable, non-transferable and there is no cash equivalent.
d. Each Prize Draw Winner is responsible for the reporting and payment of all applicable taxes (if any) as well as any other costs and expenses associated with acceptance of the Prize.
6. Selecting the Prize Draw Winner
a. The one (1) Prize Draw Winner will be drawn on Monday 3 June 2024. No more than one (1) Prize will be awarded.
b. The Prize Draw Winner will be drawn at random from all eligible entries received during the Prize Draw Period through a random computer generated process.
c. The Promoter will make all reasonable efforts to contact the Prize Draw Winner. If a potential Prize Draw Winner cannot be contacted, fails to complete any eligibility verification within seven (7) days of the time notification is sent or is deemed ineligible, then the potential Prize Draw Winner forfeits the Prize. In the event that a potential Prize Draw Winner is disqualified for any reason, the Promoter will award the Prize to an alternate Prize Draw Winner by random drawing among remaining eligible entries.
d. The Prize Draw Winners will be notified by email or telephone by Monday 3 June 2024.
e. The Prize Draw Winner first name and county of residence will be available for one (1) month after 3 August 2024 on request by contacting [email protected] unless a Prize Draw Winner has objected to such disclosure (see Clause 7 below).
7. Data protection and publicity
a. The Promoter will only process your personal information as set out in the privacy policy and in clauses 7 (a) to (c) (and any processing of personal information in clauses 7 (a) to (c) will also be subject to our privacy notice) including for the purposes of administering the Prize Draw, awarding Prizes and disclosure of Prize Draw Winner details on request.
b. The Promoter is required to publish or make available information that demonstrates a valid award of Prizes to Prize Draw Winner took place. If you are a Prize Draw Winner, you acknowledge that the Promoter will use and disclose your first name and county of residence if requested by a third party under Clause 6(e) above. Please contact us on [email protected] if you are concerned about or object to the disclosure of some or all of this information (being first name and county of residence of the Prize Draw Winner (as applicable)) for the purposes of demonstrating a valid award of Prizes took place. In such circumstances, we will disclose such information as you are happy for us to disclose but we must still provide this information to the Advertising Standards Authority on request.
c. The Promoter may wish to use the names, likenesses, photographs and cities of residence (or other personal information) of the Prize Draw Winners for promotional purposes relating to the Prize Draw or the Essential Living Locations. The Promoter will contact the Prize Draw Winner separately to obtain prior agreement to any such use.
8. Limitations of liability
a. Insofar as is permitted by law, the Promoter will not in any circumstances be responsible or liable to compensate the Prize Draw Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter. Your statutory rights are not affected.
9. General
a. The Promoter reserves the right to hold void, suspend, cancel, or amend the Prize Draw where it becomes necessary to do so.
b. The Prize Draw and these terms and conditions will be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
