Essential Living Baking Competition 2024 Terms and Conditions
For the entrant: By entering this Competition, you are indicating your agreement to be bound by these terms and conditions and acknowledge how personal information about you may be used.
1. Competition
The title of this Competition is the Essential Living Baking Competition 2024 (the Competition).
2. Promoter
The promoter is: Essential Living Management Services Limited (Company number 10201586) of 33 Cavendish Square, W1G 0PW (the Promoter).
3. How to enter
a. The Competition will run from 00:01 BST on Friday 10 May 2024 to 23:59 BST on Wednesday 15 May 2024 (the Competition Period).
b. All Competition entries must be received by the Promoter during the Competition Period. All Competition entries received prior to the start of, or after the end of, the Competition Period are automatically disqualified.
c. A resident of an Essential Living Location (as defined below) must photograph or makes a video of something they baked within the Competition Period. This can be a cake, cupcakes or any other baked good.
d. The video or photo must be posted to a public Instagram account to the feed (not Instagram stories) in order to be eligible for the prize.
e. Essential Living Location means each of the following residential locations in England: Vantage Point - Islington, Dressage Court – Bethnal Green, Berkshire House – Maidenhead and Union Wharf - Greenwich.
f. By entering this Competition, an entrant is indicating their agreement to be bound by these terms and conditions (the Competition Terms)
4. Eligibility
a. The Competition is open to all individuals aged over 18 at the start of the Competition Period who are residential tenants at an Essential Living Location during the Competition except:
i. employees of the Promoter or any company that is in the same group of companies as the Promoter;
ii. employees of agents or suppliers of the Promoter or any company that is in the same group of companies as the Promoter, who are professionally connected with the Competition or its administration;
iii. members of the immediate families or households of (i) and (ii) above;
iv. tenants who are not residents of England or located in England at the point of entry.
b. If you are not eligible to enter the Competition the Promoter will automatically exclude your entry from the Competition . The Promoter may require you to provide proof that you are eligible to enter the Competition.
c. The Promoter reserves all rights to disqualify any entrant if their conduct is contrary to the spirit or intention of the Competition or otherwise in breach of these Competition Terms. Any potential winner is subject to Promoter's verification of eligibility and compliance with law and these Competition Terms.
d. The Promoter does not take any responsibility for any technical failure or malfunction, including but not limited to any failures affecting internet servers or email systems, which may result in any entry to the Competition being lost or not properly registered or recorded.
e. Entrants are responsible for any expenses incurred to create and submit their competition entry.
5. The Prizes
a. One (1) resident of one (1) of the four (4) Essential Living Locations (the Competition Winner) will win a £50 Amazon Voucher. There will be one (1) Competition Winners in total.
b. The winner will be messaged by direct message on Instagram and asked to provide their email address.
c. The Prize will be purchased by a member of the Promoter’s marketing team and sent to the Competition Winner by email.
d. The Prize is not negotiable, non-transferable and there is no cash equivalent.
6. Selecting the Competition Winner
a. The Competition Winner will be selected on Thursday 16 May 2024. No more than one (1) Prize will be awarded.
b. The Competition Winner will be selected from all eligible entries received during the Competition Period through an anonymous voting process between employees of The Promoter.
c. The Promoter will make all reasonable efforts to contact the Competition Winner. If the potential Competition Winner cannot be contacted, fails to complete any eligibility verification within seven (7) days of the time notification is sent or is deemed ineligible, then the potential Competition Winner forfeits the Prize. In the event that a potential Competition Winner is disqualified for any reason, the Promoter will award the Prize to an alternate Competition Winner selecting from the remaining eligible entries.
d. The Competition Winners will be notified by Instagram direct message by Friday 17 May 2024.
e. The Competition Winners first name and county of residence will be available for one (1) month after Friday 17 May 2024 on request by contacting [email protected] unless a Competition Winner has objected to such disclosure (see Clause 7 below).
7. Data protection and publicity
a. The Promoter will only process your personal information as set out in the privacy policy and in clauses 7 (a) to (c) (and any processing of personal information in clauses 7 (a) to (c) will also be subject to our privacy notice) including for the purposes of administering the Competition, awarding Prizes and disclosure of Competition Winner details on request.
b. The Promoter is required to publish or make available information that demonstrates a valid award of Prizes to Competition Winners took place. If you are a Competition Winner, you acknowledge that the Promoter will use and disclose your first name and county of residence if requested by a third party under Clause 6(e) above. Please contact us on [email protected] if you are concerned about or object to the disclosure of some or all of this information (being first name and county of residence of the Competition Winner (as applicable)) for the purposes of demonstrating a valid award of Prizes took place. In such circumstances, we will disclose such information as you are happy for us to disclose but we must still provide this information to the Advertising Standards Authority on request.
c. The Promoter may wish to use the names, likenesses, photographs, competition entries and cities of residence (or other personal information) of the Competition Winners and other Entrants for promotional purposes relating to the Competition or the Essential Living Locations. The Promoter will contact the Competition Winners separately to obtain prior agreement to any such use.
8. Limitations of liability
a. Insofar as is permitted by law, the Promoter will not in any circumstances be responsible or liable to compensate the Competition Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter. Your statutory rights are not affected.
9. General
a. The Promoter reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so.
b. The Competition and these terms and conditions will be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
